These Terms of Service ("Terms") govern your access to and use of the products and services provided by Piston Labs, Inc. ("Piston Labs," "we," "us," or "our"), including:
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.
The Piston Labs GPS tracking device connects to your vehicle's OBD-II port. It collects vehicle telemetry data including location (for real-time streaming only), speed, mileage, and vehicle identification number (VIN). The device requires an active subscription for continued service.
Vehicle owners can track their vehicle's location in real-time, monitor mileage, receive maintenance reminders based on actual driving patterns, store and manage service records, and schedule appointments with participating repair shops.
Automotive repair shops receive access to a dashboard for managing their own repair orders and customer records. Shops can only view vehicle and service information that: (a) customers explicitly choose to share with them, or (b) originates from repair orders the shop itself has created. Shops do not have access to customer location data or any customer information not explicitly shared.
Businesses may use our platform to manage vehicle fleets, including real-time location monitoring, trip tracking, and driver management. Fleet services are subject to additional terms and employee notification requirements.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use our Services. By creating an account, you represent that all information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Devices may be purchased directly from Piston Labs or through authorized partners. All device sales are final. Devices come with a limited one-year warranty against manufacturing defects.
Consumer subscriptions are billed monthly at the then-current rate. Subscriptions automatically renew unless cancelled before the renewal date. Shop premium features are billed separately and subject to their own terms.
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

If you use our Services to monitor vehicles operated by employees or contractors, you are solely responsible for compliance with all applicable employment and privacy laws, including but not limited to California AB-984, which requires written notice to employees before implementing GPS tracking. You must provide employees with clear disclosure of what data is collected, how it will be used, and who has access to it.
All content, software, and technology associated with our Services, including but not limited to device firmware, mobile and web applications, algorithms, and documentation, are owned by Piston Labs or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for their intended purpose.
Our Services may integrate with third-party services such as Tekmetric (shop management), mapping providers, and payment processors. Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our data practices as described in the Privacy Policy.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the Services will be uninterrupted, error-free, or completely secure. GPS accuracy may vary based on environmental conditions, device positioning, and cellular coverage. Mileage calculations, whether from OBD-II data or GPS estimation, are approximations and should not be relied upon for legal or financial purposes.
Vehicle diagnostics and maintenance recommendations are for informational purposes only and do not replace professional mechanical inspection. We are not responsible for vehicle damage, accidents, or injuries arising from reliance on our Services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PISTON LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claims arising from these Terms or the Services shall not exceed the amounts you paid to Piston Labs in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Piston Labs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.
We may modify these Terms at any time by posting the revised Terms on our website. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Your continued use of the Services after the effective date constitutes acceptance of the modified Terms.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in any court of competent jurisdiction.
These Terms constitute the entire agreement between you and Piston Labs regarding the Services. If any provision is found unenforceable, the remaining provisions shall remain in effect. Our failure to enforce any right or provision shall not constitute a waiver. You may not assign or transfer these Terms without our consent.
